Progress — Terms of Service
Effective date: 2 October 2026 Provider: Stijn Smit, Hilversum, the Netherlands ("we", "us") Contact: support@stijnsmit.com
1. The service
Progress is a fitness and training platform for logging workouts, benchmarks, health data (weight, diet, fasting, supplements, injuries), and related content, across iOS, Android, and web ("the Service"). These Terms govern your use of the Service. The Privacy Policy governs how personal data is handled and forms part of these Terms.
2. Your account
- You must be at least 16 years old (or the age of digital consent in your country).
- You are responsible for keeping your credentials secure and for activity on your account.
- One account per person; accounts are personal and non-transferable.
3. Not medical advice — important
The Service, including all AI-generated content, exercise suggestions, recovery and rehab content, and diet-related features, provides general information only. It is not medical, nutritional, physiotherapeutic, or professional advice, and is not a substitute for consultation with a qualified professional.
- Always consult a doctor or qualified professional before starting a training program, changing your diet, fasting, taking supplements, or training with or around an injury.
- Injury-related content (including "avoid" / "safe alternative" suggestions) is general guidance based on curated information; it cannot account for your individual condition.
- You use all training and health features at your own risk. Physical training carries inherent risk of injury.
- If you experience pain, dizziness, or other concerning symptoms, stop and seek medical attention.
4. AI features
- AI features (e.g. the assistant) generate content automatically; output may be inaccurate, incomplete, or inappropriate for your situation. Verify before acting on it.
- AI features are optional, require separate consent (see the AI Feature Privacy Notice), and may require a paid subscription.
- AI output is provided "as is" and falls fully under §3 (not medical advice).
5. Your content
- You retain ownership of everything you create or upload (workouts, benchmarks, photos, videos, notes).
- You grant us a limited license to host, store, display, and transmit your content solely to operate the Service for you and anyone you share it with. We claim no other rights; we do not use your content for advertising, analytics, or AI training.
- Public content: if you set content to public or share it with friends, you grant those users the right to view and (where the feature allows) copy it for their own use within the Service.
- You are responsible for your content. Don't upload content that is unlawful, infringes others' rights, or is harmful. We may remove content that violates these Terms.
- Sharing is revocable: making content private again or removing a friend ends their access to it. Copies they made through the app's copy feature while access was granted remain theirs, with their own separate history.
- Social features may only be used to interact with people who have accepted your connection. Harassment, impersonation, or attempts to view content not shared with you violate §7 (Acceptable use).
6. Curated content
Curated exercises, workouts, benchmarks, and reference content are provided by us and remain ours. You may use them within the Service, including copying them into your own library where the feature allows.
7. Acceptable use
You agree not to:
- misuse, reverse-engineer, scrape, or disrupt the Service or its security measures;
- attempt to access other users' private data;
- impersonate others or misrepresent affiliation;
- use the Service for unlawful purposes or to distribute harmful content;
- resell or commercially exploit the Service without our written agreement (physiotherapist workflows within the app's intended features are permitted).
8. Paid features
- Progress is currently free. If we introduce paid features (e.g. the AI assistant), they will be billed via the App Store or Google Play, and we will tell you before anything you already use stops being free.
- Prices, billing periods, and trial terms are shown at purchase. Store purchases follow the store's refund and cancellation rules.
- We may change subscription pricing with notice effective from your next billing period.
9. Availability and changes
- We aim for high availability but do not guarantee uninterrupted service. Offline logging syncs when connectivity returns; you are responsible for maintaining your own device backups where critical.
- We may modify, add, or retire features. Retired curated content is archived, not destroyed — your historical logs remain viewable.
10. Termination
- You may stop using the Service and delete your account at any time, in-app. Deletion follows the Privacy Policy retention terms.
- We may suspend or terminate accounts that materially violate these Terms, with notice where reasonably possible. Upon termination you may export your data during a 30-day window unless legal reasons prevent it.
11. Disclaimers and liability
- The Service is provided "as is" and "as available", without warranties of fitness for a particular purpose, to the extent permitted by law.
- To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of data caused by factors outside our reasonable control, or injuries or health outcomes resulting from your training, diet, or use of Service content (see §3).
- Nothing in these Terms limits liability that cannot be limited by law (e.g. for intent, gross negligence, or death/personal injury caused by our negligence, where applicable law so provides).
- Where we are liable, our total liability is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or €100 if that is higher.
12. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Disputes are subject to the competent court in the district of Midden-Nederland (the Netherlands), without prejudice to mandatory consumer protections of your country of residence.
13. Changes to these Terms
We will notify you in-app of material changes before they take effect. If you don't agree, stop using the Service and delete your account before the effective date.
